Step-father sexually abused child while mother slept

WHEN a little boy was caught sexually molesting his younger brother he revealed that's what his step-father had been doing to him.

The predator would creep into the child's bedroom and abuse him after his mother had fallen asleep.

On one occasion the boy, who was aged just three and four, said his step-father bit his penis.

Mackay District Court heard the little boy still had nightmares and was insecure and anxious from the abuse.

"It came to light because he moved in with his father and he bit his own little brother on the penis and when he was asked about it he indicated that that was what (the defendant) did to him," Judge Deborah Richards said.

"You (sexually abused him) when mum was asleep in bed and you did it also when mum was in hospital."

Now 28, the man pleaded guilty to maintaining a relationship with a child between January 2013 and May 2014, and indecent treatment of a child under 12 in July 2015 west of Mackay.

Crown prosecutor Will Slack said that man, who cannot be named because it will identify his victims, also molested his step-son's cousin one night as she was sitting on his lap.

The court heard he rested his hand on the six-year-old's genital area above her clothing for about 20 minutes.

Defence barrister Scott McLennan said his client's "miserable childhood stemmed from having an absent heroin addicted father and an overwhelmed neglectful mother".

"He was sexually abused himself at the hands of a teenage friend of his eldest brother... he felt he had no one to turn to because there was no one really home," Mr McLennan said.

"By the time of these offences he was dependant on both alcohol and methylamphetamines."

A psychologist's report stated that the man showed symptoms of depression, anxiety and stress.

The court heard that when the maintaining charge came to light the man had absconded to New South Wales and had to be extradited back to Queensland to face court.

Judge Richards said the offences involved very young children, although the indecent treatment wasn't as serious as some matters that came before the courts.

The man was jailed for four years with parole eligibility in September this year after 18 months. He has already spent 356 days in custody.
