MITCHELL Terrick banged his head into a wall at a Christmas Day party and while getting medical help at Gladstone Hospital he spat phlegm and mucus that went into the mouth of a police constable.

Paramedics had asked the constable to travel in the ambulance to help because the injured man was struggling.

In the ambulance Terrick threatened to and then later spat on the officer.

Terrick, 24, pleaded guilty in Gladstone Magistrates Court to seriously assaulting the officer at 10.15pm on December 25.

Magistrate Jeffrey Clarke said Terrick's bad behaviour in the ambulance and at the hospital had been "protracted and appalling" and not simply explained away.

Terrick received an eight month jail sentence, immediately suspended, and was ordered to pay $1000 compensation to the constable.

Mr Clarke said Terrick only avoided actual jail time because of ongoing mental health issues that were explained to the court by his defence lawyer Nikki Wawryk who said he had taken alcohol that night while on medication.

Prosecutor Sam Pyke said Terrick received head injuries and in the ambulance struggled violently, threatening to kill the constable.

The first time he spat mucus it had missed the officer.

Later in the Emergency Department he spat onto the constable's face, the mucus entering his mouth.

"It was a deliberate and malicious assault on a police officer who was assisting in taking him to hospital," Snr const Pyke said.

He said it was "degrading" and had a serious impact on the officer who became very anxious and fearful about contracting a disease.

Terrick also pleaded guilty to unlawful possession of a weapon - a shotgun - ammunition and steroids at Boyne Island on December 20.

He told police they belonged to a man whose name he did not know but who had stayed at the house before leaving.

Terrick was placed on a supervised Probation Order for 18 months with drug testing.
