Pullen murder-accused committed to stand trial

THREE men have been committed to stand trial for murder over the disappearance of Mackay man Timothy Pullen after applications to downgrade charges was dismissed.

During a committal hearing defence lawyers for Zane Tray Lincoln, 37, Stephen Dale Renwick, 39 and Benjamin Francis Graeme Oakley, 27 argued the crown case couldn't substantiate evidence of an intentional killing.

They made submissions for the murder charge to be downgraded to manslaughter, while Oakley's lawyer made a no case submission.

Renwick and a fourth man Luke Shayne Kister, 25, are charged with being an accessory after the fact to murder and it was argued on their behalf charges should be dropped to accessory after the fact to manslaughter.

Magistrate Damien Dwyer, who presided over the committal hearing held earlier this month, said yesterday there was enough evidence to commit the four to the higher court on the original charges.

It is alleged that Lincoln, Renwick and Oakley murdered Mr Pullen on or about April 16 in 2012 at a Valley St unit in North Mackay.

Mr Pullen had been staying with former couple Nicholas Voorwinden and Kiera Jeannette McKay.

Both have already been jailed for manslaughter over their involvement in Mr Pullen's death.

They each gave evidence in the hearing that they knew of a plan for Lincoln to abduct Mr Pullen and hand him over to others over an alleged $30,000 drug debt. McKay also gave evidence identifying Renwick and Oakley as being with Lincoln on the night Mr Pullen was taken. Blood was found in Kister's vehicle that matched Mr Pullen's DNA.

They were committed to the Supreme Court in Mackay for a date to be set.
