Man raped girl, 13, after earlier assaulting her twin

A 38-YEAR-OLD man will spend eight months in jail for exposing himself to a 13-year-old girl then digitally raping her.

The Gailes man - who cannot be named for legal reasons - was found guilty by an Ipswich District Court jury of indecent treatment of a child and rape.

Crown prosecutor Matt Le Grand said the offences took place in 2008, when the man and his wife were looking after the daughter of a family friend.

On the night of the offending, the then 30-year-old man was alone with the girl and encouraged her to drink alcohol.

The conversation shifted to the topic of sex education to which the man asked the girl if she'd like to see his penis. When the girl said no, he showed her anyway.

The girl went to bed immediately after but was followed into her room by the man, who then digitally raped her while she pretended to be asleep.

Judge Sarah Bradley described the offence as a "gross breach of trust" which had involved "some calculation".

She noted the man had also been convicted in 2011 for two counts of indecent assault against the victim's twin sister.

For those offences he was sentenced to 20 months in prison.

"This family has been betrayed by you on two occasions," Judge Bradley told the man. "You have not demonstrated any remorse."

In a victim impact statement, the girl said she had suffered nightmares and distress as a result of the incident and had required ongoing counselling.

A psychological report noted that during the offending period the man had been suffering mental health issues which stemmed from his time in the navy.

Judge Bradley said adults who sexually exploited children for their own sexual gratification should expect to serve time in prison.

The man was sentenced to 16 months in jail, suspended for three years after serving eight months behind bars.

He was also placed on parole for three years, where he was ordered to undertake child sex offending counselling and programs.
