Fifth charged with street 'riot' granted bail

A FIFTH person charged in relation to what police described as a violent street fight between two feuding families has been granted bail.

Addison David Blane Mitchell, 20, is one of a group of people charged with "riot while armed" arising from a violent confrontation between members of two families in Cunnamulla in the early hours of New Year's Day.

He was arrested and charged on Sunday and, with four co-accused, transported to Toowoomba watch house where he remained until granted bail in the city's Magistrates Court today.

Police claim Mitchell was armed with an iron bar during the incident, but his solicitor Chelsea Saldumbide told the court her client instructed he had not struck anyone with the weapon and had only armed himself after being threatened by an opponent who was armed with an axe.

Her client was not one of those who had to be sprayed with capsicum spray during the melee and in police statements officers said Mitchell had been genuinely remorseful for his involvement, she said.

At an earlier bail application hearing, police claimed co-accused Tegan Maree Mitchell, 33, had been armed with a large shovel but she claimed to have taken that shovel off another combatant and denied a police allegation that she had also been armed at one point with a golf club.

The motivation behind the altercation has not as yet been aired in court with all accused having their respective cases adjourned for further court appearances in Cunnamulla in the coming months.

Ms Saldumbide submitted her client had never been held in custody before and the two nights he had been in the watch house had been a sobering time for him.

Her client had a bail address in Dalby where he would live while on remand, she submitted.

Magistrate Graham Lee granted Mitchell bail and adjourned his case until March 7.
