Elderly driver who never held licence busted twice in year

AN ELDERLY man whose driving concerned a cyclist told the court he wasn't aware he didn't have a licence despite records showing no proof he had ever held one.

The Caloundra Magistrates Court heard how a lack of public transport was Jack John Green's reasoning to drive unlicensed after being busted twice in a matter of months.

Police prosecutor Lee Allan said police received concerns from a cyclist about the 79-year-old's driving in July last year and more checks discovered he was not a licence holder.

Senior Sergeant Allan said when police busted Green in November he told officers his last licence was held more than 16 years ago in New South Wales.

The court heard Green had no evidence of this, and police couldn't find any proof he ever held a licence on available records.

Magistrate Stephanie Tonkin questioned Green's authority to drive without a licence and Green told the court he thought he had one, despite not having a licence in his possession.

"No one is allowed to drive just believing they are licensed,” she said.

Green, who lives in the Maleny area, said he had since obtained a learner licence.

Ms Tonkin said a lack of public transport was no excuse and his behaviour was "not good enough”.

Green was fined $600 and disqualified from driving for six months.

A conviction was recorded.
