Dr Vega Vega seeks to lift suspension by CQHHS

A DOCTOR has lodged legal action to lift a suspension, without pay, from his public duties at Rockhampton hospital.

Antonio Vega Vega was suspended while he faced disciplinary proceedings this year for removing the wrong kidney from a young woman during a seven-hour surgery at Rockhampton hospital on January 22.

But the Queensland Civil and Administrative Tribunal has since found Dr Vega Vega did "not pose a serious risk to persons".

In documents lodged in the Brisbane Supreme Court on Tuesday, Mr Vega Vega sought a judicial review of the Central Queensland Hospital and Health Service decision.

The court application said he was aggrieved because he was suspended from duty, was prevented from carrying out his professional work and he was prevented from receiving his normal remuneration.

It argued the suspension was not authorised and breached the rules of natural justice.

Dr Vega Vega seeks reasons for the decision, an order to set aside the decision to suspend him and wants the hospital to pay court costs.

A directions hearing is set down for August 8.
