Mackay dad’s shocking fine for dodging tax man
A MAN who failed to pay his tax for almost a decade has been fined $8500 and forced to pay court costs.
Sky Gregory Henry, 40, pleaded guilty in a Townsville court after failing to submit his tax return for nine years from the year ending June 30, 2010 to June 30, 2018.
The Mackay man owed more than $24,000 to the Australian Taxation Office.
The court was told Henry, who is a father of two, was going through personal difficulties and his tax return was a "low priority".
The court heard Henry was given his final notice in October 2019, with the requirement to lodge before December 2019.
It was not until May 10, 2021 that Henry submitted his overdue tax returns.
ATO prosecutor Renee Spicer said Henry's current tax records show he earned $108,246 a year.
Defence lawyer Andrew Peel said Henry worked for WHF Group as a project manager and was currently working on the redevelopment and reconstruction of Shute Harbour at Airlie Beach.
He said Henry was the "sole breadwinner" of his relationship.
"In respect to the offending itself, it commenced in 2010 when my client was experiencing a number of personal difficulties," Mr Peel said.
"Although they do not directly contribute to his failing to lodge tax returns, he said the filing of the material would have been a very 'low priority' as a result of what he was going through.
"As time progressed and he continued to fail to lodge tax returns, it did play on his mind that he was unaware of what the consequences were, unfortunately he took the path of least resistance and decided to ignore his obligations instead of proactively dealing with them."
He said his client was able to pay a fine.
Mr Peel said when his client was served with a summons, he immediately engaged a tax agent and was now up to date with his obligations.
Henry has no previous criminal history.
Magistrate Cathy Wadley fined Henry $8500 and ordered him to pay $230.49 in court costs to the ATO. Convictions were recorded.
