Boy, 14, poses as adult seeking sex on gay dating website

DISTURBING details of how a 14-year-old boy accessed an adult homosexual dating website to arrange sexual contacts with adult men were revealed in the Maroochydore District Court this week.

A man - who the Daily decided not to name - appeared by video link from jail where he spent 403 days after he was arrested for a charge of sodomy and using the internet to procure a child under16.

It was also revealed the man, who pleaded guilty to the charges of sodomy and using the internet to procure a child under 16, was HIV positive.

Judge John Robertson arranged for the man's immediate release after learning the full details of the case.

There was no doubt the initial contact was instigated by the boy, posing as an adult, who then left his home about 4.40am to go the man's house, where the sexual encounter occurred.

The sexual encounter was "completely consensual".

Defence lawyer Anna Smith also revealed that days later the boy again posed as an adult on the dating site and arranged a meeting with another man, whose sentence was understood to be under appeal.

The boy had not complained to the police, but details emerged when he told friends at school and his mother became involved and contacted police.

The 30-year-old man was arrested and jailed in December 2013 and hadn't been released since.

Judge Robertson sentenced the man to three years' imprisonment, suspended after he had served 403 days for a period of three years.

On the two other counts, the man was sentenced to 12 months' imprisonment, to be released on probation for two years.
