Boy, 12, raped teenager

A 12-YEAR-OLD boy who broke into a girl's room at night and raped her has been given probation.

The boy held the 17-year-old girl down while he sexually assaulted her in April despite her pleas for him to stop.

She eventually struggled free and the boy, who was extremely intoxicated, escaped out the window.

Ipswich District Court heard when confronted by an adult while still outside the Goodna home, the boy said he would get his sisters to come back and bash her.

Crown Prosecutor Kathleen Christopherson said a psychologist's report showed the child, now aged 13, was sexually aroused by rape scenes in movies and enjoyed video games in which he ran over prostitutes with a car.

“He's shown no insight into his offending or victim empathy,” Ms Christopherson said.

The court heard the boy broke into a string of homes and stole property to exchange with older boys for cannabis and alcohol.

He also assaulted a 12-year-old boy sitting outside a school in December last year and an 11-year-old girl earlier this year.

Judge Sarah Bradley said she would have ordered a custodial sentence if the boy had not already spent 133 days in juvenile detention awaiting sentence.

When asked what he thought about juvenile detention, the boy replied it was “boring”.

He pleaded guilty to assault occasioning bodily harm, four charges of stealing, common assault, two charges of burglary and stealing, receiving tainted property, burglary, rape and possessing tainted property.

The boy was sentenced to three years probation with no conviction recorded and he was ordered to do a youth sexual offender program.

Defence barrister Timothy Ryan said the boy had no criminal history until the spate of offences which began in December.

Mr Ryan said his client was of low intelligence and had been a victim of his father's violence – receiving a broken leg in a beating when he was eight years old.
