Aboriginal group challenges custody powers

A NORTHERN Territory Aboriginal legal group is attempting to contest the Territory's controversial "protective custody" police powers in the High Court.

The North Australian Aboriginal Justice Agency has applied to the High Court for leave to appeal a recent NT court's decision backing the laws, which allow police to lock up drunken people who have not committed a crime.

NAAJA lawyer Jonathon Hunyor said more than 90% of those arrested were Aboriginal and the challenge aimed to ensure police used the powers in a "fair and proper way".
