He almost had his licence back... then he lied to police

DISQUALIFIED driver Raymond Mercy had just 12 weeks to go until getting his licence back.

Busted driving illegally on Boxing Day he told police a porky, claiming a friend had been driving but ran off.

However, Mercy, 41, pleaded guilty in Gladstone Magistrates Court to driving unlicensed when caught disqualified on December 26.

Prosecutor Gavin Reece said police saw Mercy's ute pull off the Dawson Highway at 9.30pm and park before reaching the RBT site.

No one left the ute as officers walked up and found Mercy behind the wheel.

"Police had their eyes on the vehicle at all times," Mr Reece said.

"He was in the driver's seat and says a mate was driving who fled on foot when he saw the RBT.

"No police saw anyone else and Mr Mercy refused to say who the friend was."

Mr Reece said his licence was disqualified for two years by court order in March 2014.

Lawyer Jun Pepito said Mercy should not have made up stories but been up front with police.

Magistrate Penelope Hay said Mercy had been dishonest and also driven unlicensed in 2011, 2013, and 2014 drove when disqualified.

Ms Hay sentenced him to two months jail but suspended the sentence for two years, saying the jail term hanging over his head should act as deterrence.

She warned Mercy he would go straight to jail if caught again. He will be off the road until March 2018.
