Quiz a cop: Do pets need to be restrained in cars?

Unsure of the law? Well Gladstone Police have offered to help by answering your questions about what you can and cannot do.

January 28:

Q: If I have a pet inside my vehicle while I am driving, does it need to be restrained?

A: While there is no legal requirement to restrain a pet that is travelling inside a vehicle, it is recommended that all animals be restrained to ensure the safety and welfare of all occupants of the vehicle and of the animal itself.

If the pet interferes with the driver's control of the motor vehicle, or if the animal is in the drivers lap then it becomes an offence as outlined in section 297 (1A) of the Transport Operations (Road Use Management-Road Rules) Regulation 2009. The driver could receive a traffic infringement notice with a penalty of $274 or a maximum penalty in court of up to $2356.

January 14:

Question: Are there any time restrictions on when I can phone police to make a noise complaint?

Answer: A member of the public can make a complaint, including an anonymous complaint, to a police officer about noise emitted from a place.

This complaint can be made at any time of the day or night.

If the police officer deems the noise to be excessive, the officer may issue a noise abatement direction.

The time period of a noise abatement direction is 96 hours after the direction is given to the responsible person, this means no loud noise can be made from the place for four days!

To report a complaint about noise to police, you can complete a noise complaint form online or phone Policelink on 131 444. If the noise that is occurring relates to domestic or other violence or a party that is getting out of control, please contact triple zero (000) immediately.

January 7:

Question: Is it OK to speed while overtaking?

Answer: Constable Dayne Weiss-Marsh from the Calliope Road Policing Unit had the answer.

"No, in Queensland you can not exceed the speed limit to overtake another vehicle," he said.

"If it is not safe to overtake a vehicle at the posted speed limit then do not overtake."
