PUBLIC NOTICE OF INTENTION TO COMMENCE INDIGENOUS LAND USE AGREEMENT (AREA AGREEMENT) PROCESS UNDER THE NATIVE TITLE ACT 1993 (CTH) Australia Pacific LNG Pty Limited and its related entities (APLNG) proposes to develop a world scale, long-term coal seam gas (CSG) to liquefied natural gas (LNG) project in Queensland (Australia Pacific LNG Project). The Australia Pacific LNG Project comprises 3 principal components: the further development of APLNG's CSG fields in South Central Queensland (Gas Project); the construction and operation of a high pressure underground gas transmission pipeline system from the CSG fields to a LNG facility on Curtis Island, near Gladstone, where the CSG will be liquefied (Pipeline Project); and the construction and operation of the LNG facility and of ancillary onshore and marine facilities, including a marine offloading facility and an export terminal containing specialised LNG loading facilities and berths so that the LNG can be exported to international markets (Plant Project). APLNG proposes to enter into an Indigenous Land Use Agreement (Area Agreement) (ILUA), pursuant to Subdivision C of Division 3 of Part 2 of the Native Title Act 1993 (Cth) (NTA), in relation to that part of the Pipeline Project shown in the map below (ILUA Project). The proposed ILUA Area is located wholly within the external boundaries of the Gaangalu Nation registered native title claim (Federal Court No. QUD400/12, NNTT No. QC12/9) (Gaangalu Nation Claim). The native title claim group for the Gaangalu Nation Claim is described in the claim as comprising all persons who are biologically descended from the following deceased ancestors (all of whom are recognised by the living Gaangalu claim group members as having been Gaangalu): Maggie of Dingo, Biddy of Wooroona, Sandy of Wooroona, Henry Williams of Duaringa, Jack (of Coomooboolaroo), Billy Mickelo, Claude and Anne Anderson, Rose Ann Tyson, Biddy (wife of Jumbo), Lizzy Tiger (Blackwater), Blanche of Duaringa, Annie French, Polly Doctor, Annie of Orion Downs, Annie and Ned Duggan, Peter Tyson, Lily of the McKenzie River Bend, John 'Jack' Bradley, Violet Thompson, Jenny Doctor (not the daughter of Polly Doctor), Polly McEvoy/Brown, Queenie (Hart) of Duaringa, (Brothers) Charlie, Willie and George Riley, Lily/Lilla Livingstone and William Toby. The ILUA will provide for the consent of the native title parties to certain Agreed Acts to be set out in the ILUA, including the grant of all approvals and land tenure for the ILUA Project, and to the undertaking of the ILUA Project. APLNG will be seeking that the non-extinguishment principle apply to the proposed Agreed Acts and to the undertaking of the ILUA Project. Negotiations for the ILUA are about to commence. In accordance with the NTA, all reasonable efforts must be made to ensure that all persons who hold or may hold native title in relation to land or waters in the proposed ILUA Area are identified.
